Proactive Health Analysis Terms of Service - Terms of Service (TOS)

1. Acceptance of Terms

By using ProActive Health Analysis ("Service"), you agree to these Terms of Service. If you do not agree, please do not use the Service.

2. Data Storage and Analysis History

Our Service stores and maintains a history of your health analyses. This includes:

  • Analysis timestamps and dates
  • Biomarker data (including names, values, units, reference ranges, and status indicators)
  • Basic measurements (such as height, weight, BMI, and body fat mass when provided)
  • Analysis results and interpretations

You have the ability to:

  • View your complete analysis history
  • Search through your past analyses
  • Delete individual analyses and associated data from your history
  • Print your analysis results
  • View trends and visualizations of your biomarker data over time

2.1 Data Retention and Deletion

Your analysis history will be retained in our system until you choose to delete it. You can delete individual analyses at any time through your account interface. Deleted analyses cannot be recovered. We may retain certain anonymized or aggregated data derived from your analyses for service improvement purposes.

2.2 Data Access and Control

Your analysis history is private and accessible only to you through your authenticated account. You maintain control over your data and can manage it through the provided interface. We do not share your individual analysis data with third parties unless required by law.

2.3 Informational Use Only

The content provided by our Service, including your analysis history, trends, workout plans, and meal plans, is for informational purposes only and does not constitute medical or professional advice. All analyses, workout recommendations, and nutritional guidance should be reviewed with and approved by qualified healthcare providers, certified fitness professionals, and/or registered dietitians before implementation. You should never disregard professional medical advice or delay seeking it because of information provided by our Service.

2.4 Non-Affiliation with Medical Facilities

ProActive Health Analysis is not affiliated with, endorsed by, or in any way associated with any medical facilities, healthcare providers, or medical professionals. We are an independent service provider that offers AI-powered analysis tools for informational purposes only.

2.5 HIPAA Status

ProActive Health Analysis is not a covered entity or business associate as defined by the Health Insurance Portability and Accountability Act (HIPAA). While we implement robust security measures to protect your information, our service is not designed to comply with HIPAA requirements.

2.6 Meal Plan Shopping Links

Our Service may provide shopping links to third-party retailers (such as Walmart) for ingredients used in meal plans. By using these links, you acknowledge and agree that:

  • These links are provided for convenience only
  • You are solely responsible for reviewing all ingredients for potential allergens and dietary restrictions
  • You assume all risk associated with purchasing and consuming any food items
  • We make no guarantees regarding ingredient availability, pricing, or suitability
  • We are not responsible for any adverse reactions, allergic responses, or health issues resulting from the consumption of suggested ingredients
  • We do not receive any compensation for purchases made through these links
  • We may receive compensation through affiliate programs when purchases are made through these links
  • We do not process or provide refunds for any purchases made through affiliate links; all refund requests must be directed to the retailer where the purchase was made
  • You should consult with a healthcare provider or registered dietitian before making significant changes to your diet
  • The quantities of items populated in your shopping cart may be more or less than what is required by the recipes
  • You are responsible for reviewing and adjusting the quantities in your cart to match your specific recipe needs
  • The shopping cart population feature is provided solely for convenience and may not perfectly match recipe requirements

2.7 Workout Plans

Our Service provides AI-generated workout plans based on your body composition data and preferences. By accessing these workout plans, you acknowledge and agree that:

  • All workout plans are provided for informational purposes only
  • The workout plans do not constitute professional exercise advice
  • You should consult with certified fitness professionals, physical therapists, or other qualified exercise professionals before following any workout plan
  • You are responsible for exercising within your personal fitness and health limitations
  • We are not responsible for any injuries, health complications, or adverse effects resulting from following our workout plans
  • You should stop any exercise immediately if you experience pain, discomfort, dizziness, or any concerning symptoms
  • You should not begin any exercise program without proper clearance from your healthcare provider, especially if you have pre-existing health conditions
  • The workout plans are generated based on limited information and may not be suitable for your specific needs or limitations

2.8 Data Visualization and Graphs

Our Service provides AI-generated data visualizations and graphs based on your biomarker data. By viewing these visualizations, you acknowledge and agree that:

  • All graphs and visualizations are generated programmatically using AI for informational purposes only
  • The visualizations may not represent a complete or fully accurate interpretation of your data
  • Trend lines and correlations shown in graphs are approximations and should not be used for diagnostic purposes
  • Data points may be interpolated or estimated when historical data is limited
  • Significant fluctuations in graphed data should be discussed with healthcare providers
  • The color-coding and classifications (like "normal," "high," or "low") are general guidelines only and may on occasion be incorrect
  • You should consult healthcare providers for interpretation of any visualized data
  • We are not responsible for decisions made based on the visual representation of your biomarker data

3. Use of Third-Party AI Services (GROK)

Our Service utilizes GROK, an AI-powered tool, to interpret de-identified medical records. By using our Service, you acknowledge that:

  • While our system employs robust protected health information (PHI) removal safeguards, you retain ultimate responsibility for protecting your health information.
  • You will have the opportunity to review and approve all de-identified text before any transmission to GROK.
  • We cannot control how GROK processes de-identified data once it is transmitted.
  • We are not responsible for any actions, interpretations, or recommendations provided by GROK.
  • You are responsible for ensuring no sensitive or identifying information is included in the final text you approve for transmission.

4. Data Security and Privacy

We implement reasonable security measures to protect your stored analysis history and personal information. However, no method of transmission over the Internet or electronic storage is 100% secure. We cannot guarantee absolute security of your data. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • Ensuring your account is not accessed by unauthorized users
  • Reviewing and verifying the accuracy of your stored data
  • Promptly reporting any unauthorized access or security concerns

5. User Responsibilities

You agree not to misuse the Service, including but not limited to:

  • Submitting false or misleading information
  • Attempting to breach security features
  • Using the Service for unlawful purposes
  • Attempting to access other users' analysis histories
  • Sharing your account credentials with others
  • Using workout or meal plans without proper consultation with healthcare or fitness professionals

6. Limitation of Liability

We make no guarantees regarding the accuracy, reliability, or applicability of the information provided, including stored analysis history, trend data, workout plans, and meal plans. We are not liable for any decisions made based on the results generated by this Service or by GROK, nor for any injuries, health complications, or adverse reactions that may result from following workout or dietary recommendations without proper professional guidance.

7. Service Availability

We reserve the right to modify, suspend, or discontinue the Service at any time without notice. This includes the potential loss of stored analysis history.

8. Governing Law

These Terms are governed by the laws of AZ/USA. Any disputes shall be resolved in maricopa county, AZ.

9. Changes to Terms

We may update these Terms. The latest version will be available on our website. Continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Data Export and Portability

You may export your analysis history and results through the provided print functionality. We do not guarantee the availability of additional data export formats or methods.

The Service may contain technical inaccuracies or typographical errors. We make no representations about the reliability, availability, timeliness, or accuracy of the Service or stored analysis history.

13. Age Restrictions

You must be at least 18 years old to use this Service and store analysis history. By using the Service, you represent and warrant that you are at least 18 years old.

14. Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account, including access to stored analysis history. You agree to notify us immediately of any unauthorized use of your account.

15. Termination

We reserve the right to terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason. Upon termination, your right to access your stored analysis history will cease.

16. Data Backup

While we maintain regular backups of our systems, we are not responsible for creating backups of your individual analysis history. We recommend regularly exporting or printing important analyses for your records.

17. Third-Party Access

We do not provide direct access to your analysis history to third parties, including healthcare providers. You may choose to share your analysis results with healthcare providers or others by using the provided print or export functionality.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
